dont l'am\u00e9nagement int\u00e9rieur n'est pas connu au stade du d\u00e9p\u00f4t de la demande de permis de construire.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e7999b2 elementor-widget elementor-widget-text-editor\" data-id=\"e7999b2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-size: 14px; color: var( --e-global-color-3eca3ab ); text-align: var(--text-align);\">Dans le cadre d&rsquo;un projet portant sur un immeuble collectif de logement et de locaux \u00e0 destination de professions lib\u00e9rales en rez-de-chauss\u00e9e (ERP de type W de 5e cat\u00e9gorie), la SCCV p\u00e9titionnaire a obtenu un permis de construire.<\/span><\/p><p><span style=\"font-size: 14px; color: var( --e-global-color-3eca3ab ); text-align: var(--text-align);\">En pratique, il ressortait express\u00e9ment du dossier de permis de construire, notamment de la notice architecture et de la notice d&rsquo;accessibilit\u00e9 que l&rsquo;am\u00e9nagement int\u00e9rieur des cellules destin\u00e9es \u00e0 des professions lib\u00e9rales n&rsquo;\u00e9tait pas connu lors du d\u00e9p\u00f4t de la demande de permis de construire.\u00a0\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3295885 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"3295885\" data-element_type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li construire de l'obligation, pour le p\u00e9titionnaire, de demander et d'obtenir une autorisation compl\u00e9mentaire avant l'ouverture au public de l'\u00e9tablissement.<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-8230172 e-con-full e-flex e-con e-child\" data-id=\"8230172\" data-element_type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-8c99724 e-con-full e-flex e-con e-child\" data-id=\"8c99724\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-ae45314 elementor-widget elementor-widget-text-editor\" data-id=\"ae45314\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En droit, il ressort des dispositions de l&rsquo;article L<span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041587200\">. 425-3<\/a><\/span> du code de l&rsquo;urbanisme que lorsqu\u2019un projet porte sur un \u00e9tablissement recevant du public (ERP), le permis de construire tient lieu de l\u2019autorisation pr\u00e9vue par l\u2019article <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041564679\">L. 122-3<\/a><\/span> du code de la construction et de l\u2019habitation. Le permis de construire mentionne alors les prescriptions impos\u00e9es au p\u00e9titionnaire, relatives \u00e0 l\u2019exploitation des b\u00e2timents.<\/p><p class=\"p1\">En revanche, lorsqu\u2019au stade du d\u00e9p\u00f4t du dossier de demande de permis de construire, <b>l\u2019am\u00e9nagement int\u00e9rieur de l\u2019ERP<\/b> ou d\u2019une partie de celui-ci <b>n\u2019est pas connu<\/b>, le permis de construire <b>doit indiquer express\u00e9ment qu\u2019une autorisation compl\u00e9mentaire au titre <\/b><b>de l\u2019article <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041564679\">L. 122-3<\/a><\/span> du code de la construction et de l\u2019habitation devra \u00eatre demand\u00e9e <\/b><b>et obtenue<\/b>, en ce qui concerne l\u2019am\u00e9nagement int\u00e9rieur du b\u00e2timent ou de la partie de b\u00e2timent concern\u00e9e, post\u00e9rieurement \u00e0 l\u2019obtention du permis de construire mais avant l\u2019ouverture au public de l\u2019ERP concern\u00e9.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-5a1a4af e-con-full e-flex e-con e-child\" data-id=\"5a1a4af\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-435ce16 elementor-alert-info elementor-widget elementor-widget-alert\" data-id=\"435ce16\" data-element_type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\t\t\t<span class=\"elementor-alert-title\">Article L. 425-3 du code de l'urbanisme<\/span>\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00ab Lorsque le projet porte sur un \u00e9tablissement recevant du public, le permis de\nconstruire tient lieu de l\u2019autorisation pr\u00e9vue par l\u2019article L. 122-3 du code de la\nconstruction et de l\u2019habitation d\u00e8s lors que la d\u00e9cision a fait l\u2019objet d\u2019un accord de\nl\u2019autorit\u00e9 administrative comp\u00e9tente qui peut imposer des prescriptions relatives \u00e0\nl\u2019exploitation des b\u00e2timents en application de l\u2019article L. 143-2 du code de la\nconstruction et de l\u2019habitation. Le permis de construire mentionne ces prescriptions.\nToutefois, lorsque l\u2019am\u00e9nagement int\u00e9rieur d\u2019un \u00e9tablissement recevant du public ou\nd\u2019une partie de celui-ci n\u2019est pas connu lors du d\u00e9p\u00f4t d\u2019une demande de permis de\nconstruire, le permis de construire indique qu\u2019une autorisation compl\u00e9mentaire au\ntitre de l\u2019article L. 122-3 du code de la construction et de l\u2019habitation devra \u00eatre\ndemand\u00e9e et obtenue en ce qui concerne l\u2019am\u00e9nagement int\u00e9rieur du b\u00e2timent ou de\nla partie de b\u00e2timent concern\u00e9e avant son ouverture au public \u00bb<\/span>\n\t\t\t\n\t\t\t\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a6fbe50 elementor-widget__width-inherit elementor-widget elementor-widget-heading\" data-id=\"a6fbe50\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Une interpr\u00e9tation jurisprudentielle stricte de ces dispositions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ff69ba0 e-con-full e-flex e-con e-child\" data-id=\"ff69ba0\" data-element_type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-80c209a e-con-full e-flex e-con e-child\" data-id=\"80c209a\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-77a0f75 elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"77a0f75\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Lorsque l\u2019am\u00e9nagement int\u00e9rieur d\u2019un ERP ou d\u2019une partie de celui-ci n\u2019est pas connu au jour du d\u00e9p\u00f4t du dossier de demande de permis de construire, il appartient, <b>sans <\/b><b>exception possible<\/b>, \u00e0 l\u2019autorit\u00e9 comp\u00e9tente de <b>mentionner express\u00e9ment, dans la <\/b><b>d\u00e9cision d\u2019octroi de l\u2019autorisation demand\u00e9e, l\u2019obligation pour le p\u00e9titionnaire de <\/b><b>demander et d\u2019obtenir une autorisation compl\u00e9mentaire avant l\u2019ouverture au public du <\/b><b>b\u00e2timent.<\/b> Si une telle mention ne figure pas dans l\u2019arr\u00eat\u00e9 portant octroi du permis de construire sollicit\u00e9, ce dernier encourt <b>l\u2019annulation de mani\u00e8re certaine.<\/b><\/p><p class=\"p1\">Peu importe que le p\u00e9titionnaire ait expos\u00e9 dans son dossier de demande de permis de construire avoir connaissance de l\u2019obligation de solliciter une autorisation compl\u00e9mentaire. Cela n\u2019a pas d\u2019impact sur le caract\u00e8re obligatoire de la mention pr\u00e9cit\u00e9e, au sein de l\u2019arr\u00eat\u00e9 portant octroi de l\u2019autorisation d\u2019urbanisme sollicit\u00e9e.<\/p><p><span style=\"color: #333333; font-family: Roboto, sans-serif; font-size: 13px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; white-space-collapse: preserve;\">\u00ab <em>9. Il r\u00e9sulte de ces dispositions que lorsque, comme en l\u2019esp\u00e8ce, l\u2019am\u00e9nagement int\u00e9rieur de locaux constitutifs d\u2019un \u00e9tablissement recevant du public, qui n\u00e9cessite une autorisation sp\u00e9cifique au titre de l\u2019article L. 111-8 du code de la construction et de l\u2019habitation, n\u2019est pas connu lors du d\u00e9p\u00f4t de la demande de permis de construire, l\u2019autorit\u00e9 comp\u00e9tente, dont la d\u00e9cision ne saurait tenir lieu sur ce point de l\u2019autorisation pr\u00e9vue par le code de la construction et de l\u2019habitation, <strong>ne peut l\u00e9galement d\u00e9livrer le permis sans mentionner express\u00e9ment l\u2019obligation de demander et d\u2019obtenir une autorisation compl\u00e9mentaire avant l\u2019ouverture au public, et ce alors m\u00eame que le contenu du dossier de demande de permis de construire t\u00e9moignerait de la connaissance, par le p\u00e9titionnaire, de cette obligation.<\/strong> Par suite, et alors que la ville de Paris ne peut utilement se pr\u00e9valoir du contenu de la demande de permis de construire pour soutenir que les juges du fond auraient d\u00e9natur\u00e9 sur ce point les faits et les pi\u00e8ces du dossier, le tribunal n\u2019a pas commis d\u2019erreur de droit en jugeant que le permis de construire litigieux \u00e9tait ill\u00e9gal au motif qu\u2019il ne comportait pas, pour l\u2019am\u00e9nagement du local<\/em><br \/><em>commercial pr\u00e9vu au rez-de-chauss\u00e9e de l\u2019un des deux b\u00e2timents, la mention exig\u00e9e par l\u2019article L. 425-3 du code de l\u2019urbanisme<\/em>. \u00bb <\/span>CE 23 mai 2018 <i>Office public de <\/i><i>l&rsquo;habitat Paris Habitat<\/i>, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000036960389\"><span class=\"s1\">req. n\u00b0 405976<\/span><\/a><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-df14fa9 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"df14fa9\" data-element_type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<svg aria-hidden=\"true\" class=\"e-font-icon-svg e-fas-check-circle\" viewBox=\"0 0 512 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path d=\"M504 256c0 136.967-111.033 248-248 248S8 392.967 8 256 119.033 8 256 8s248 111.033 248 248zM227.314 387.314l184-184c6.248-6.248 6.248-16.379 0-22.627l-22.627-22.627c-6.248-6.249-16.379-6.249-22.628 0L216 308.118l-70.059-70.059c-6.248-6.248-16.379-6.248-22.628 0l-22.627 22.627c-6.248 6.248-6.248 16.379 0 22.627l104 104c6.249 6.249 16.379 6.249 22.628.001z\"><\/path><\/svg>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Le simple renvoi \u00e0 diverses prescriptions, et notamment \u00e0 celles formul\u00e9es par la commission d\u00e9partementale de s\u00e9curit\u00e9 et d\u2019accessibilit\u00e9 ne sont pas de nature \u00e0 d\u00e9montrer le respect des dispositions de l\u2019article L. 425-3 du code de l\u2019urbanisme<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-9b71469 e-con-full e-flex e-con e-child\" data-id=\"9b71469\" data-element_type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-1f55270 e-con-full e-flex e-con e-child\" data-id=\"1f55270\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-02043f0 elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"02043f0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-size: 14px; color: var( --e-global-color-3eca3ab ); text-align: var(--text-align);\">Dans l&rsquo;affaire objet du pr\u00e9sent commentaire, la commune et la SCCV p\u00e9titionnaire soutenaient que l&rsquo;arr\u00eat\u00e9 de permis de construire \u00e9tait r\u00e9gulier en d\u00e9pit de l&rsquo;absence de mention expresse de l&rsquo;obligation de demander et d&rsquo;obtenir<\/span> une autorisation compl\u00e9mentaire au titre de l\u2019article L. 122-3 du code de la construction et de l\u2019habitation <span style=\"font-size: 14px;
